Terms and Conditions
The Service
Auto Rescue Solutions provides you with easy access to highly qualified automotive roadside assistance technicians with whom you can schedule a service on your vehicle to be performed at your home, place of work, or other location you select. Any work performed by a technician through the Service is referred to as a “Job”, "Call" or “Work Order”. All technicians performing a Work Order through the Service are independent contractors operating for Auto Rescue Solutions.
Arrangement of Service
You must contact and schedule Auto Rescue Solutions to use the Service. This can be done via https://roadside.autorescuesolutions.com/ or by phone. When you schedule your Job you will be asked to provide your contact information. This may include your name, email address and phone number. You also will be asked to identify the vehicle that will be serviced when you schedule a specific Job. When you schedule a Job you will be asked to provide a credit card you will use to pay for the Service.
Scheduling a Job
To request an appointment with a technician for a Job, submit a request through on the Site (a "Job Request"). You will be asked to specify the following information: (i) the make, model, year and color of your vehicle and/or its license plate number, (ii) the location where you would like the Job performed, and (iii) the date and time you would like the Job performed. You will then be able to schedule your job.
At the time you schedule a Job you will be required to provide a valid major credit or debit card and billing information as explained in more detail below. After your card is validated your Job will be confirmed and you will receive more information on the technician who will perform the Job.
Cancellations
If you need to cancel a Job you scheduled before the work is performed, please call us as soon as possible at: 833-942-4008. If you are able to cancel a retail service within 5 minutes of ARS calling, confirming the WO AND the technician is not En route, ARS will issue a FULL refund. If you cancel a retail service 5 minutes after ARS calls to confirm the WO OR after a technician is En route to the service, a partial refund of will be issued. A partial refund will be your original payment minus the $35 dispatching fee. We ask that if you need to cancel you do so as soon as possible before the Job is scheduled to be performed as you may be charged a cancellation fee if the technician is in route to your location. If a Technician arrives on scene and there was information that wasn't given to the dispatcher prior which inhibits the Technician from completing the job a partial refund will not be issued. Information that wasn't given prior can include but not limited to: not having a spare tire, not having a lug nut key, the vehicle being parked on an unsafe ground to perform service, etc.
Refund Policy
As previously mentioned, cancelations within 5 minutes of an ARS dispatcher contacting the customer will be issued with a FULL refund. The only other situations when a full refunds will be issued are: If the ARS Dispatch team did not verify the customers location and the location the Customer originally gave was incorrect. The Dispatch team did not verify the Technician had the correct tools for the Rescue. The Dispatch team did not verify the fuel type when a customer is needing a Fuel Delivery. There is no available Technician in the area that a customer is needing service.
Partial refunds will be issued when: The customer was unaware of their stripped lug-nuts. The customer was unaware of needing a lug-nut lock tool. The customer was unaware they did not have an undermounted spare tire tool. The customer was unaware that a spare tire service is for a spare tire change and not a NEW tire installation service. When a Technician arrives however service cannot be attempted due to a Vehicle issue such as a wrecked front-end. The customer cancels after the 5 minute period of an ARS dispatch agent calling the customer or if a Technician is enroute.
Refunds will NOT be issued when: Service is attempted but failed and/or requires tow. The address was verified by the dispatch team but the address of the vehicles location is still incorrect. The location given to ARS was incorrect even after being verified by someone from the dispatch team. The customer left the vehicle at some point before the Technician arriving on scene. Technicians are not able to perform a service on a Vehicle when not attended by the Customer. The Technician was unable to find the Motorist after on scene and contacting the customer by phone.
Towing Terms & Conditions
These terms and conditions govern the use of the towing service ("Service") provided by Auto Rescue Solutions ("we," "us," or "our"). By using our Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you must not use our Service.
Towing Description of Service
Our Service connects customers in need of towing services with third-party contractors who will provide towing services to the customer. We do not provide towing services ourselves, and we are not responsible for the actions or omissions of the third-party contractors. We only offer refunds to customers who cancel their request before a contractor is dispatched.
Towing Payments
Customers will be charged a fee for the use of our Service, which includes a fee for connecting the customer with a third-party contractor who will provide towing services. Payment must be made in advance through our website or mobile application. We accept major credit cards and other payment methods that we may make available from time to time. All payments are final and non-refundable, except in the case where the customer cancels their request before a contractor is dispatched.
Towing Third-Party Contractors
We do not employ the third-party contractors who provide the towing services to our customers. We do not guarantee the availability, reliability, or performance of the third-party contractors, and we are not responsible for any acts or omissions of the third-party contractors. The third-party contractors are independent contractors, and not employees, agents, or representatives of ours. We do not have control over the quality, timing, legality, or any other aspect whatsoever of the services that the third-party contractors provide, nor of the integrity, responsibility, or any of the actions whatsoever of the third-party contractors.
Towing Liability
We do not assume any liability for any damages, losses, or expenses arising out of or in connection with the use of our Service, including any damages, losses, or expenses arising out of or in connection with the acts or omissions of the third-party contractors. By using our Service, you acknowledge and agree that we are not liable for any damages, losses, or expenses arising out of or in connection with the use of our Service.IndemnificationYou agree to indemnify and hold us harmless from any and all claims, damages, losses, or expenses arising out of or in connection with your use of our Service, including any claims, damages, losses, or expenses arising out of or in connection with the acts or omissions of the third-party contractors.
Towing Modification of Terms and Conditions
We reserve the right to modify these terms and conditions at any time, in our sole discretion. We will notify you of any material changes to these terms and conditions by posting a notice on our website or mobile application. Your continued use of our Service after any such modification constitutes your acceptance of the modified terms and conditions.
Towing Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the state where our company is located, without giving effect to any principles of conflicts of law. You agree that any action arising out of or in connection with these terms and conditions must be brought in the state or federal courts located in the state where our company is located, and you consent to the jurisdiction of such courts.
Towing Entire Agreement
These terms and conditions constitute the entire agreement between you and us with respect to the use of our Service, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us with respect to such use.
Tire Inflation Liabilities
Regarding Tire Inflation: I understand that Auto Rescue Solutions reccomends a Spare Tire change instead of a tire inflation and that any liability or risk is accepted by paying for the service. The risks include, but are not limited to: tire blowouts, tire blowouts that may lead to vehicle damage, bodily injury arising from the tire of issue, but not limited to, pasengers in the vehicle, other drivers, pedestrians, damage to other vehicles, public or private property. I hereby assume all risks associated by requesting and paying for a Tire Inflation in this event.
Auto Rescue Solutions, or its technicians, will not be held liable for any of risks mentioned above when I as the Customer & Motorist accepts/pays for the service.
I understand that Auto Rescue Solutions provides their services exclusively on locations where they have the consent of the property owner or manager to operate. I agree to have arranged all necessary permissions required to service my vehicle in the location it will be parked at the time of my appointment. I understand that failure to arrange these permissions may result in an Auto Rescue Solutions Technician being removed from the service location mid-service, potentially rendering my vehicle disabled. Service visit fees will apply should this be the case.
Payment Terms
Auto Rescue Solutions uses a third party payment processor, to validate credit and debit cards and process payments. Auto Rescue Solutions does not store your credit or debit card information. When you schedule a Job you will be asked to authorize a charge to your card upon completion of booking the Job for the amount of the quote you accepted on the Site for the Job you want performed. Your debit or credit card will be charged for the amount specified, as well any applicable sales tax, if any. In the event a cancellation occurs and a partial or full refund is needed, please allow 3-5 business days for the charge to be reversed with your bank or card issuer.
Prohibited Actions; Termination
As a condition for your access to the Service, you agree not to make any separate payment or other payment arrangements with the technician who performs the Job. Auto Rescue Solutions reserves the right to terminate your Job request for any failure by you to comply with the foregoing or any other terms of this Agreement.
Must of 18 or older to Use the Service
The Service is not available to anyone under 18 years of age, and you represent that you are at least 18 years old when you submit a Job Request. Job Request Submitted by an Entity If you submit a Job Request for a business entity, you represent that you have the authority to bind that entity to this Agreement.
Intellectual Property
Subject to the terms and conditions of this Agreement, Auto Rescue Solutions hereby grants to you a limited, non-exclusive, nontransferable right to access and use the Service, subject to the terms of this Agreement.
You acknowledge that all of the intellectual property rights in the Service are owned by Auto Rescue Solutions or its licensors. You shall not (i) reproduce, modify, publish, transmit, distribute, publicly perform or display, sell, or create derivative works based on the Service; or (ii) rent, lease, loan, or sell access to the Service. We reserve the right to modify, enhance, or discontinue the Service at any time.
Limitations of Liability
YOU ACKNOWLEDGE THAT ALL ROADSIDE ASSISTANCE WORK SPECIFIED UNDER SERVICE IS PROVIDED BY INDEPENDENT CONTRACTORS. IN NO EVENT WILL AUTO RESCUE SOLUTIONS BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN AN ACTION FOR CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WHETHER OR NOT AUTO RESCUE SOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. The foregoing limitations shall apply to the maximum extent permitted by law and shall survive indefinitely.
Miscellaneous
Governing Law. This Agreement and the relationship between you and Auto Rescue Solutions will be governed by the laws of the state of Texas, without giving effect to any choice of laws principles that would require the application of the laws of a different country or state.
Dispute Resolution. Any claim or controversy between you and Auto Rescue Solutions arising out of, or relating to, this Agreement shall be finally decided by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association by a single arbitrator appointed in accordance with such rules. Subject to any valid requirements of any applicable statute, any such arbitration shall be held in the location of our business. During the course of any arbitration hereunder, each party will bear its own costs and attorneys' fees, and share equally the arbitrator's fees and expenses, except that the arbitrator shall award to the prevailing party all reasonable attorneys' fees resulting directly or indirectly from such arbitration. The award rendered by the arbitrator shall be final, and judgment may be entered upon it at any court having jurisdiction. The arbitrator shall have the authority to award temporary, preliminary and permanent injunctive and equitable relief in the arbitration. Any arbitration hereunder will be confidential.
No Assignment. You may not assign your rights under this Agreement without our prior written consent, and any attempted assignment will be null and void.
Force Majeure. Any delay in the availability of the Service or the performance of any Job will not be considered a breach of this Agreement if such delay is caused by a fire, earthquake, flood, war, terrorist act, governmental act, failure of common carriers (including Internet service providers), act of God, or any other event beyond the control of Auto Rescue Solutions or the technician, provided that performance is resumed as soon as possible.
Severability. If any provision of this Agreement is held or determined to be invalid, unenforceable, or void, the remainder of this Agreement shall remain in full force and effect.
Entire Agreement; No Waiver. This Agreement constitutes the entire agreement between you and Auto Rescue Solutions regarding the use of the Service. Our failure to exercise or enforce any right or provision of the Agreement will not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect.
Use of Pictures. Auto Rescue Solutions LLC. may use all likeness of the vehicle booked for roadside assistance and location of services in internal training and external marketing campaigns. Individual customer information such as residential address, customer name, facial likeness, license plate number/vehicle identification number will be protected and any external use must be expressly approved by the customer/representing party.
Notices. We may give notice to you by email or other reasonable means. You must give notice to Auto Rescue Solutions by first class USPS mail to: 2121 Midway Rd, Carrollton, TX 75006.

By accessing and using the services of Auto Rescue Solutions, I hereby accept and agree to be bound by the terms and conditions of this agreement.
